For those who believe in the values of liberalism and democracy the state is under a political obligation to seek the common welfare of its citizens. In furtherance of this domestic duty, it retains among its external rights and powers that right of self-defense which has been assigned to states under other ideologies.

Understanding why individuals opt out of living donation is crucial to enhancing protections for all living donors and to identify modifiable barriers to donation. We developed an ethical approach to conducting research on individuals who opted out of living kidney donation and applied it in a small-scale qualitative study at one US transplant centre. The seven study participants had varied reasons for opting out, the most prominent of which was concern about the financial burden from lost wages during the postoperative (...) period. Several reported feeling alone during their decision-making process. Although no participants used an alibi, a centre-provided statement of non-eligibility to donate, all believed that centres should offer alibis to help preserve donor autonomy. Given the complexity of participants' decisions and the emotions they experienced before and after deciding not to donate, we suggest approaches for independent living donor advocates to support this population. This study demonstrates that research on individuals who opt out of donation is feasible and yields valuable insight into methods to improve the evaluation experience for potential living donors. Readers of Theodor Adorno often have understood him as a "totalizing negativist." If it truly is the case that Adorno saw modern society as a realm of complete falsehood, however, his own social theory is unintelligible. In A Precarious Happiness, Peter E. Gordon aims to redeem Adorno from this negativist interpretation by showing that it arises from a basic misunderstanding of his work. Pushing against entrenched interpretations, Gordon argues that Adorno's philosophy is animated by a deep attachment (...) to a concept of happiness or human flourishing, and it is only by virtue of that normative standard that Adorno judges the world a catastrophic failure. Through a comprehensive reading of Adorno's work, A Precarious Happiness shows that in an imperfect world, the available standards of our flourishing are also imperfect. Looking beyond Adorno, Gordon suggests that the practice of social criticism, even if it is directed toward exposing what is "false," cannot succeed without appealing to an unrealized notion of what would be right. In his article, ‘Milgram's Shocking Experiments’, in Philosophy 52 , Professor Steven C. Patten rejects Milgram's evidence for a Hobbesian view of human nature on three grounds: that the claim that a large number of the subjects in the experiments were not deceived is not convincing, that there is a conceptual conflation by Milgram of two senses of obedience, and that a proper understanding of kinds of authority will explain in an acceptable way the behaviour of most of the small (...) number of subjects who might remain to support Milgram's conclusions. The author does not take for granted that censorship is wrong, but equally what he has written is in no way an apology for censorship. He offers no solution to the problem of the proper extent of censorship in a society. This essay investigates the tradition of interwar German-Jewish political theology associated most of all with Leo Strauss and Franz Rosenzweig. It is suggested here that the Straussian notion of an eternal conflict between politics and religions may be derived, in part, from Rosenzweig's image of the depoliticized Jewish community. Furthermore, this "concept of the apolitical" represents something like a modernist reprisal of Stoic ideals, most especially the ancient ideal of ataraxia, or "freedom from disturbance." This apoliticism is distinguished most of (...) all by two interlocking principles; first, that politics is mere disorder if not a return to the state of unredeemed nature; and second, that religious peace must accordingly be found elsewhere than politics. This argument for the near-incommensurability of politics and religion represents the special if not altogether unique contribution of Weimar German-Jewish intellectuals to the enduring tradition of political theology. It is therefore worth posing the following question: Why does Hannah Arendt's political theory appear to bear almost no trace whatsoever of this political-theological tradition? By what logic did Arendt dissent from the political-theological principles that so captivated her German-Jewish contemporaries? And which tradition should command our allegiance today? (shrink)

From the beginning to the end of his career, the critical theorist and Frankfurt School philosopher Theodor W. Adorno sustained an uneasy but enduring bond with existentialism. His attitude overall was that of unsparing criticism, often verging on polemic. In Kierkegaard he saw an early paragon for the late flowering of bourgeois solipsism; in Heidegger an impresario for a "jargon of authenticity" that cloaked its idealism in an aura of pseudo-concreteness and neo-romantic kitsch; even in the more rationalist tradition of (...) Husserl's phenomenology he detected a vain attempt of the bourgeois spirit to break free from the prison-house of immanent consciousness. Yet his enduring fascination with the philosophical canons of existentialism and phenomenology suggests a connection far more complicated and productive than mere antipathy. From his first published book on Kierkegaard's aesthetic to the mature studies in negative dialectics, Adorno was forever returning to the philosophies of bourgeois interiority, seeking the paradoxical relation between their manifest failure and their hidden promise. Scholars of critical theory often regard these philosophical adventures as unfortunate lapses into reductive sociology or as marginal to Adorno's path of intellectual development. In Adorno and Existence, Peter E. Gordon challenges this assumption, showing how the confrontation with existentialism helps us toward a deeper understanding of Adorno's own intellectual commitments. I ask whether it is necessary that principles of number be mentally represented and point to the role of language in determining cultural variation. Some cultures possess extensive counting systems that are finite. I suggest that learning number principles is similar to learning conservation and, as such, might be derived from learning about the empirical properties of objects and other individuals in combinations.

When did historians begin to put quotation marks around the wordreal? There are many examples of this habit and some of them will be set forth as evidence in what follows. But before doing so we might ask a preliminary question: What are the quotation marksthemselvessupposed to mean? Today we find them so familiar they hardly need to be written and they are more frequently consigned to the everyday repertoire of silent gesture: two fingers on either hand clutch at the (...) air as if they meant to tickle the flanks of the invisible beast between them. The popular term is “scare-quotes,” a pun on the word “scarecrow.” Its etymology is revealing: just as a mere representation of a body in a field may scare off birds, so too scare-quotes permit someone to deploy a word without sincere commitment to what it normally means. But further reflection tells us that the effects are not so similar after all: To use a term without sincerity robs it of its original meaning and holds up its lifeless corpse to ridicule. The more knowing sort of crow can settle on the shoulder of the figure on the pole precisely because it recognizes that such a sorry excuse for a man can in fact harm no one. Similarly when one putsrealityin quotation marks we are put in mind of the living concept but we are immediately alerted to the fact that, for the user at least, the new term enjoys no metaphysical prestige. How did this happen? When and why did the single most privileged word in the entire lexicon of metaphysics begin to lose its authority such that in certain spheres of intellectual sophistication its sincere use would only seem an embarrassment and a sign of naïveté? Macphail’s comparative approach to intelligence focused on associative processes, an orientation inconsistent with more multifaceted lay and scientific understandings of the term. His ultimate emphasis on associative processes indicated few differences in intelligence among vertebrates. We explore options more attuned to common definitions by considering intelligence in terms of richness of representations of the world, the interconnectivity of those representations, the ability to flexibly change those connections, knowledge, and individual differences. We focus on marine mammals, represented by the amphibious pinnipeds (...) and the aquatic cetaceans and sirenians, as animals that transitioned from a terrestrial existence to an aquatic one, experiencing major changes in ecological pressures. They adapted with morphological transformations related to streamlining the body, physiological changes in respiration and thermoregulation, and sensory/perceptual changes, including echolocation capabilities and diminished olfaction in many cetaceans, both in-air and underwater visual focus, and enhanced senses of touch in pinnipeds and sirenians. Having a terrestrial foundation on which aquatic capacities were overlaid likely affected their cognitive abilities. Vocal and behavioral observational learning capabilities in the wild and in laboratory experiments suggest versatility in group coordination. Empirical reports on aspects of intelligent behavior like problem-solving, spatial learning, and concept learning by various species of cetaceans and pinnipeds, suggest rich cognitive abilities. The high energy demands of the brain suggest brain-intelligence relationships might be fruitful areas for the study when specific hypotheses are considered, e.g., brain mapping indicates hypertrophy of specific sensory areas in marine mammals. Modern neuroimaging techniques provide ways to study neural connectivity, and the patterns of connections between sensory, motor, and other cortical regions provide a biological framework for exploring how animals represent and flexibly use information in navigating and learning about their environment. At this stage of marine mammal research, it would still be prudent to follow Macphail’s caution that it is premature to make strong comparative statements without more empirical evidence, but an approach that includes learning more about how animals flexibly link information across multiple representations could be a productive way of comparing species by allowing them to use their specific strengths within comparative tasks. The United Kingdom’s approach to encouraging environmentally positive behaviour has been three-pronged, through voluntarism, incentives and regulation, and the balance between the approaches has fluctuated over time. Whilst financial incentives and regulatory approaches have been effective in achieving some environmental management behavioural change amongst farmers, ultimately these can be viewed as transient drivers without long-term sustainability. Increasingly, there is interest in ‘nudging’ managers towards voluntary environmentally friendly actions. This approach requires a good understanding of farmers’ willingness and ability to take (...) up environmental activities and the influences on farmer behavioural change. The paper aims to provide insights from 60 qualitative farmer interviews undertaken for a research project into farmers’ willingness and ability to undertake environmental management, particularly focusing on social psychological insights. Furthermore, it explores farmers’ level of engagement with advice and support networks that foster a genuine interest, responsibility and a sense of personal and social norm to sustain high quality environmental outcomes. Two conceptual frameworks are presented for usefully exploring the complex set of inter-relationships that can influence farmers’ willingness to undertake environmental management practices. The research findings show how an in-depth understanding of farmer’s willingness and ability to adopt environmental management practices and their existing level of engagement with advice and support are necessary to develop appropriate engagement approaches to achieve sustained and durable environmental management. This essay examines Adorno's notoriously puzzling concept of metaphysical experience with special attention to Adorno's remarks on the concept in his 1965 lecture‐course, “Metaphysics: Concepts and Problems.” The essay argues that the concept of metaphysical experience is best understood in the light of Adorno's philosophical critique of metaphysics in the traditional sense. It was Adorno's view that in the age of modern catastrophe, the category of traditional metaphysics (as theorized chiefly by Aristotle, Plato, and Empedocles) could no longer retain its (...) validity, and the notion of “experience” itself was withering away. Adorno concluded that metaphysics in the modern era would have to be reconceived as a category of loss that reflected the damage that had been done to human life. “Metaphysical experience” attached itself especially to special places or childhood memories, even while such privileged experiences also reflected the disappointment and imperfection that marks all experiences today. SummaryThough Peter Gordon mentioned philosophical anthropology in his book Continental Divide, he has not yet realized how it works independently from Cassirer's and Heidegger's prejudices. The whole argument between them before, in and after Davos raged around the status of philosophical anthropology: How do the spiritualisation of life and the enlivening of the spirit come about? This was not just the central question for philosophical anthropology founded by Max Scheler, but also in Wilhelm Dilthey's life philosophy, which was (...) systematized by Georg Misch. Cassirer and Heidegger shared three shortcomings with respect to the Life-philosophical Anthropology. Neither had a philosophy of nature or a philosophy of sociaty or a philosophy of history. The insight into the unfathomability of humans is given a political edge in Helmuth Plessner's book Power and Human Nature. Elevating it to the principle of democratic equality with respect to the worth of all cultures one opens up the potential for a form of civil competition that might supersede ethnocentric wars. Franz Rosenzweig is widely regarded today as one of the most original and intellectually challenging figures within the so-called renaissance of German-Jewish thought in the Weimar period. The architect of a unique kind of existential theology, and an important influence upon such philosophers as Walter Benjamin, Martin Buber, Leo Strauss, and Emmanuel Levinas, Rosenzweig is remembered chiefly as a "Jewish thinker," often to the neglect of his broader philosophical concerns. Cutting across the artificial divide that the traumatic memory of National (...) Socialism has drawn between German and Jewish philosophy, this book seeks to restore Rosenzweig's thought to the German philosophical horizon in which it first took shape. This essay places some conceptual pressure on the model of a “learning process” in Jürgen Habermas’s Auch eine Geschichte der Philosophie, and it asks whether this model introduces a subtle asymmetry into the relationship between religion and secular philosophy. Such an asymmetry would seem to obtain insofar as religious tradition is granted a privileged or unique status as the source of normative insights that are then available for rational scrutiny and translation into secular life. The essay also draws a comparison (...) between Lessing and Habermas: Lessing, like Habermas, saw revelation as a source of instruction for humanity, and affirmed that religion could thereby play a role in the Erziehung des Menschengeschlechts. But Lessing was careful to say that no valuable normative contents are found in religion that could not also be derived by secular reason alone. Habermas’s genealogy of post-metaphysical thinking does not seem to confirm Lessing’s idea; instead, it appears to confirm an asymmetry in the relation between religion and secular philosophy.
